Terms and Conditions of Service

Do not use AllSet unless you agree to these Terms and Conditions:

1. Definitions

In these Terms and Conditions:

  • "AllSet" means the AI-powered booking management platform operated by AllSet Digital Ltd (UK Company number 16034768).
  • "Service" means the booking management and payment processing functionality provided by AllSet through WhatsApp.
  • "Business" means any service provider using AllSet to manage bookings and payments for their Services.
  • "Customer" means any person making bookings for Services through AllSet.
  • "Services" means fixed-duration, fixed-price services offered by a Business to Customers through AllSet.
  • "Booking" means the agreement between a Business and Customer for the provision of Services at a specific time.
  • "Content" means any information submitted through AllSet.
  • "User" means any Business or Customer using AllSet.

2. Scope of Service

2.1 AllSet provides an AI-powered platform through which:

  • Businesses can manage bookings and payments for their Services.
  • Customers can book and pay for Services offered by Businesses.
  • All parties can manage related communications through WhatsApp.

2.2 Users explicitly acknowledge that AllSet:

  • Is solely a booking facilitation platform.
  • Does not provide any of the underlying Services being booked.
  • Bears no responsibility for Service delivery or quality.
  • Processes but does not store payment details.
  • Acts solely as an intermediary between Users.

3. Acceptable Use

3.1 The platform may only be used for:

  • Booking legitimate, fixed-duration Services.
  • Processing payments for such Services.
  • Managing booking-related communications strictly pertaining to scheduling and payments.

3.2 Prohibited Uses include:

  • Sale of physical goods.
  • Any illegal activities.
  • Services that violate local laws in either the Business's or Customer's jurisdiction.
  • Adult or inappropriate content.
  • Gambling or betting services.
  • Financial services.
  • Services that promote hate, violence, or discrimination.
  • Any activities that could harm AllSet's reputation.
  • Attempting to manipulate, modify, or override AllSet's AI system behavior.
  • Attempting to extract unauthorized information from AllSet's systems.
  • Using AllSet for general conversation or topics unrelated to bookings, payments, or scheduling.
  • Attempting to circumvent platform restrictions or security measures.

3.3 AllSet reserves the right to:

  • Determine what constitutes acceptable use.
  • Refuse service to any User.
  • Remove any Content.
  • Terminate access for violations.

3.4 System Security and Monitoring:

  • AllSet monitors and logs all platform interactions.
  • Attempts to compromise system security or behavior will result in immediate account termination.
  • AllSet may report serious violations to relevant authorities.
  • Banned users may not create new accounts or access the service through alternative means.

3.5 Fair Usage:

  • AllSet reserves the right to establish and modify usage limits.
  • Excessive platform usage may result in account suspension or termination.
  • Usage limits are not publicly disclosed for security reasons.
  • AllSet has sole discretion in determining excessive usage.
  • Users exceeding reasonable usage patterns may be charged additional fees or have service restricted.

4. International Use

4.1 The Service is available internationally, subject to:

  • Local laws and regulations.
  • Payment processing availability.
  • Technical limitations.

4.2 Users must:

  • Comply with all applicable local laws.
  • Accept responsibility for determining legality in their jurisdiction.
  • Pay any applicable taxes or duties.
  • Ensure Services offered/booked are legal in both parties' jurisdictions.

4.3 These Terms shall be governed by English law, but Users retain any mandatory consumer rights in their jurisdiction.

5. Payment Terms

5.1 Users acknowledge that:

  • All payments are processed by third-party providers.
  • AllSet bears no responsibility for payment errors.
  • All refunds must be arranged directly between Users.
  • AllSet fees are non-refundable.
  • Payment terms may change without notice.

6. Data Protection and Privacy

6.1 In processing personal data, AllSet:

  • Acts as a data processor for Businesses.
  • Processes data only as necessary to provide the Service.
  • Implements appropriate technical and organizational measures.
  • Assists Businesses in fulfilling their GDPR obligations.
  • Deletes or returns personal data as requested by Businesses.

6.2 Businesses acknowledge they are data controllers and must:

  • Comply with all applicable data protection laws.
  • Obtain necessary consents from Customers.
  • Handle data subject requests.
  • Maintain appropriate records of processing.
  • Notify AllSet of any data protection issues.

6.3 All Users acknowledge that:

  • Data transmission carries inherent risks.
  • AllSet cannot guarantee data security.
  • Users should maintain their own data backups.

7. Service Modifications

7.1 AllSet reserves the right to:

  • Modify or discontinue any aspect of the Service.
  • Change pricing structures.
  • Add or remove features.
  • Modify these Terms.
  • Restrict service access.

8. User Obligations

8.1 Users must:

  • Handle their own customer service.
  • Resolve their own disputes.
  • Maintain their own records.
  • Process their own refunds.
  • Accept all risks of using the Service.

9. Service Availability

9.1 The Service is provided "as is" without any guarantees of:

  • Uninterrupted availability.
  • Error-free operation.
  • Message delivery.
  • Data preservation.
  • Technical reliability.
  • Retrieval of lost data.

10. Termination

10.1 AllSet may terminate or suspend any User's access:

  • Without prior notice.
  • For any violation of these Terms.
  • For any use outside acceptable use guidelines.
  • To comply with law or protect platform integrity.
  • Without liability.

11. Governing Law and Jurisdiction

11.1 These Terms are governed by English law.

11.2 For Business Users:

  • Courts of England have exclusive jurisdiction.

11.3 For Customers:

  • May bring claims in their local courts if required by mandatory consumer protection laws.
  • Otherwise, submit to English jurisdiction.

By using AllSet, you acknowledge that you have read, understood, and agree to be bound by these Terms.
